Welcome to Vibeshift! These Terms of Service ("Terms") govern your use of the Vibeshift mobile application and web platform (collectively, the "Service"). By using Vibeshift, you agree to these Terms. If you do not agree, please do not use the Service.

1. Use of the App

• You must be at least 16 years old to use Vibeshift.
• You agree to use the Service only for lawful purposes and in accordance with these Terms.
• You are responsible for maintaining the security of your account credentials and any data stored within the Service.
• You agree not to misuse the Service, including attempting to access data belonging to other users or organizations.

2. User Data & Privacy

• Wellness assessments you submit are aggregated anonymously to provide team-level insights to your organization. Your individual responses are never shared with your employer in identifiable form.
• Journal entries are private to your account. No one else, including your employer, HR team, or managers, can access them.

3. Account & Organization

• Employees join Vibeshift via an invitation from their company. You may only access the organization you have been invited to.
• Company administrators (owners) can manage their organization, including inviting or removing employees and viewing aggregated wellness data.
• If you leave your organization or your access is revoked by an administrator, you may lose access to organization-specific features.

4. Account Deletion

You may delete your account at any time by following the instructions on our Delete Account page. Deleting your account will permanently remove your personal data from our systems, except where retention is required by law or where aggregated anonymous data has already been contributed.

5. Intellectual Property

• Vibeshift and its content (excluding your personal data) are the property of Bearacle LLC and protected by copyright and other intellectual property laws.
• You may not copy, modify, distribute, or create derivative works from the Service or its content without prior written permission.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be error-free, uninterrupted, or free of harmful components. Vibeshift is a wellness tool and does not constitute medical or professional health advice.

7. Limitation of Liability

To the fullest extent permitted by law, Bearacle LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

8. Changes to These Terms

We may update these Terms from time to time. If we make changes, we will update the Effective Date at the top of this page. Continued use of the Service after changes become effective means you accept the new Terms.
