Clear Roam

These Terms of Service ("Terms") govern your use of Clear Roam — the mobile application and the pages at bearacle.com/clear-roam (together, the "Service"), published by Bearacle LLC. By creating an account or buying a plan, you agree to these Terms. If you do not agree, please do not use the Service.

1. What the Service Is

Clear Roam sells prepaid mobile data plans delivered as eSIM profiles, for use while you travel. You choose a destination and a plan, we obtain an eSIM profile for it, and you install that profile on your device.

We are a reseller, not a mobile network operator. The eSIM profiles and the underlying connectivity are supplied by our wholesale partner, eSIM Access, and delivered over local carriers in each country. We do not own or operate any network, and we cannot control coverage, speed, or a carrier's decisions about its own service.

2. Your Device Must Be Compatible

Before you buy, it is your responsibility to confirm that your device meets both of these conditions:

  • It supports eSIM. Most phones released in the last few years do; many do not, including some models sold in specific regions.
  • It is carrier-unlocked. A phone locked to the network that sold it will refuse a third-party eSIM profile, even if the hardware supports one.

An eSIM profile is issued to your order the moment you buy. If it turns out your device cannot use it, that is not a fault in the plan, and section 6 explains what can and cannot be refunded. Check first — it takes a minute and it is the single most common cause of a plan that will not work.

3. Accounts

You need an account to buy a plan, because your eSIMs and your purchase history have to belong to someone. You can sign in with your email address, with Apple, or with Google.

Keep your sign-in method secure. You are responsible for activity under your account. Tell us promptly at info@bearacle.com if you believe someone else has access to it.

4. Prices and Payment

  • All prices are shown and charged in US dollars.
  • Payment is taken by card through Stripe, our payment processor. Bearacle LLC is the merchant of record. We never see or store your full card number.
  • Your card is authorised when you order, and charged only once a working eSIM has been issued to you. If we cannot obtain a profile, the authorisation is released and no money is taken. Depending on your bank, a released authorisation can take a few business days to disappear from your statement.
  • Prices can change at any time. The price you are shown at checkout is the price for that purchase.
  • Any tax that applies to your purchase is calculated at checkout and included in what you are charged.

5. Activation, Validity and Data

  • A plan's validity period begins when the eSIM first connects to a network in its coverage area — not when you buy it, and not when you install it. Install before you travel; the clock starts when you arrive.
  • Once the validity period ends, any remaining data is forfeited. Unused data does not carry over and is not refundable.
  • Data allowances are stated in the plan. A "daily" plan gives you that allowance for each day of its length; a fixed plan gives you a single pot for the whole period.
  • Some plans described as unlimited apply a fair use policy: after a stated amount of full-speed data, the connection continues at a reduced speed. Where a plan does this, the app tells you before you buy, and again at checkout.
  • Usage figures shown in the app are reported by the network and can lag by several hours. Treat them as indicative, not as a real-time meter.

6. Refunds

Because an eSIM profile is issued to you as soon as you buy, refunds depend on whether it has been used:

  • Not installed and never activated — we can normally cancel the profile and refund you in full. Contact us before the plan's validity window has elapsed.
  • Installed or activated — the plan has been provisioned on a live network and generally cannot be refunded, whether or not you used the data.
  • Genuinely faulty — if a plan does not work in its stated coverage area for reasons on our side or our supplier's, tell us and we will investigate. Where the fault is confirmed, we will refund or replace it.
  • Incompatible device — see section 2. If the profile has not been installed we will usually still refund you, but we cannot do so once it has been activated.

Request a refund from the eSIM's screen in the app, or email info@bearacle.com. We aim to respond within a few business days. Nothing here affects statutory rights you may have where you live.

7. Coverage and Service Quality

Coverage maps and carrier lists describe where a plan is intended to work. Actual service depends on the local carrier, your location, your device, and conditions we do not control.

We do not guarantee any particular speed, latency, or uninterrupted availability. Voice calls and SMS are not included unless a plan explicitly says so — these are data-only plans.

8. Acceptable Use

  • Use the Service and any plan only for lawful purposes, and in line with the local carrier's terms in the country you are in.
  • Do not resell, redistribute, or commercially exploit a plan or an eSIM profile.
  • Do not use a plan for permanent connectivity in a single country in place of a local subscription. These are travel plans, and a carrier may terminate service that is used this way.
  • Do not attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service or the systems behind it.

We may suspend or terminate an account that breaches this section, or that we reasonably believe is being used fraudulently.

9. Third Parties

Delivering the Service means working with others: eSIM Access supplies the profiles, local carriers supply the connectivity, Stripe processes payments, and Apple or Google may provide your sign-in. Their own terms apply to their own services. They are not responsible for the Service, and the Service is not responsible for them.

10. Availability

We may change what the Service offers, add or withdraw destinations and plans, or stop offering the Service, at any time. If we withdraw the Service entirely we will honour plans already sold, or refund those that cannot be honoured.

11. Intellectual Property

  • The Clear Roam name, the app's design, interface, text, and software are the property of Bearacle LLC and are protected by copyright and other laws.
  • You may not copy, modify, distribute, or create derivative works from the Service without our permission.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that it will be uninterrupted or error-free, that a plan will work in any particular place at any particular moment, or that your device will accept an eSIM profile.

13. Limitation of Liability

To the fullest extent permitted by law, Bearacle LLC shall not be liable for any indirect, incidental, or consequential loss, including missed connections, lost bookings, business interruption, or any loss arising from being unable to get online.

Where liability cannot be excluded, our total liability for any claim relating to a plan is limited to the amount you paid for that plan. Nothing in these Terms limits liability that cannot be limited by law.

14. Changes to These Terms

We may update these Terms from time to time. If we do, we will update the Effective Date at the top of this page. Continued use of the Service after changes become effective means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law rules. This does not deprive you of the protection of mandatory consumer law in your country of residence.
